Wills (Including living Wills) and Probate
We deal with all the legal steps needed to collect in the assets of someone who has died and distribute them to the beneficiaries named in the Will or if there is no Will to the legal next of kin.
Advice for older people
We advise elderly clients and their families on such matters as:
  • reducing the amount the local authority can take from their savings if they have to go into a care home;
  • obtaining all the state benefits available to them.
  • making Lasting Powers of Attorney - which appoint a relative or friend to look after their financial affairs - and implementing these if the person becomes mentally incapable; and advising the best course of action if there is neither an Enduring or a Lasting Power of Attorney.
Note: Since 1st October 2007 it is no longer possible to make an Enduring Power of Attorney but one made before that date remains fully valid. It does not need to be replaced with a Lasting Power of Attorney, unless the person who made it wishes to extend it to cover matters relating to his or her welfare as well as financial matters.

Make a Will

We know that you care about what happens to your assets in the future and you welcome the peace of mind that making a Will brings.  

Keep it up to date

But from time to time it is good practice to review your Will to make sure that it reflects your wishes at the present time.

Make a Lasting Power of Attorney

We would also like to draw your attention to the options available for keeping both your assets and yourself safe whilst you are alive.   This can be covered by preparing a document called a Lasting Power of Attorney (LPA). An LPA is an important legal document that enables a person who has capacity, and is over the age of eighteen, to choose another person or persons to make decisions on their behalf if they become unable to do so.

Is your property registered?

A large number of properties in the Stapleford area are not registered with the Land Registry...
